(Nurjani) EFEKTIVITAS HUKUMAN TERHADAP PELAKU POLITIK UANG DALAM PILKADA DAN PEMILU: REFLEKSI MENGHADAPI PEMILU 2024

Abstrak

Politik uang telah menjadi masalah serius dalam proses demokratisasi di Indonesia. Penelitian ini menginvestigasi hukuman terhadap pelaku politik uang pada Pemilihan Kepala Daerah dan Pemilihan Umum sebelumnya sebagai persiapan untuk Pemilu 2024. Penelitian ini menganalisis berbagai jenis hukuman pengadilan yang dijatuhkan kepada pelaku politik uang dengan mengambil contoh kasus di Pilkada Cianjur dan Pilkada Tasikmalaya tahun 2020 ditambah saat Pemilu 2019. Metodologi yang digunakan adalah analisis data sekunder dan studi kasus dari pemilu-pemilu sebelumnya. Hasil penelitian menunjukkan bahwa meskipun sudah ada upaya untuk menegakkan hukuman terhadap pelaku politik uang, namun masih ada tantangan dalam memberlakukan hukuman dari majelis hakim yang efektif salah satunya hakim tidak menggali hukum lain yang hidup dimasyarakt. Secara sistem juga sangat berpengaruh karena tumbuh patronase klientialisme dalam Pemilihan Legislatif dari tingkat pusat sampai Kota Kabupaten dan faktor Undang-Undang yang memuat hukuman sehingga politik uang terus marak disetiap pemilihan maupun pemilu. Untuk refleksi menghadapi Pemilu dan Pilkada serentak 2024 penulis menyarankan agar Undang-Undang Pemilihan dan Pemilu disatukan dengan sanksi hukuman yang sama seperti pemberlakuan kalusul setiap orang dan penerima uang dipidana juga dalam pemilu.

Abstract

Money politics has become a serious problem in Indonesia's democratization process. This research investigates the punishment of perpetrators of money politics in the previous Regional Head Elections and General Elections in preparation for the 2024 General Elections. This research analyzes the various types of court sentences imposed on perpetrators of money politics taking case examples in the Cianjur Regional Head Election and Tasikmalaya Regional Head Election in 2020 plus the 2019 General Election. The methodology used is secondary data analysis and case studies from previous elections. The results showed that although there have been efforts to enforce penalties against perpetrators of money politics, there are still challenges in enforcing penalties from an effective panel of judges, one of which is that judges do not explore other laws that live in the community. The system is also very influential because of the growing patronage of cliententialism in Legislative Elections from the central to the Regency City level and the factor of the Law containing penalties so that money politics continues to be rampant in every election and election. For a reflection on the simultaneous elections and regional elections in 2024, the author suggests that the Election and Election Laws be unified with the same penalties as the enactment of the kalusul for every person and the recipient of money is also punished in the election.
